IN RE: LEGAL REALITY AND THE FIRST AMENDMENT

The Individual Freedoms ( Rights of Liberty ) that are expressly defined in the First Article in Addition to, and Amendment of the Constitution of the United States of America, i.e., the Freedoms of Religion, Speech, Press, Assembly and Petition are not Freedoms granted to or bestowed upon the People of the United States by the First Amendment or, for that matter, by the original US Constitution itself. Rather the First Amendment, in explicitly acknowledging certain Freedoms, unquestionably forbids the US Congress from abridging or in effect prohibiting the People’s Free exercise of these enumerated Rights of Liberty - unalienable Rights of Liberty unanimously declared, on the occasion of their Independence, as an Endowment from their Creator.

As professed at the founding of the Nation, the aforementioned Individual Freedoms are only part of the totality of unalienable Rights that all men (people) are Endowed with by their Creator. Accordingly, to deny or abridge the People’s Freedom to Officially recognize the existence of their Creator, the very Source of their acknowledged Freedoms, would be to de facto deny and abridge the People’s Endowed Rights of Liberty, Rights of Liberty bestowed upon them by their Creator. Consequently, it is a Legal Reality, i.e., it is by operation of law, that the First Amendment can not in word or effect prohibit or restrict the People’s Overt and Official recognition of their Creator as the Source of their unalienable Rights of Liberty, a Creator declared by their Authority as Nature’s God and of necessity forever active in the Affairs and Institutions of their Nation.

In point of fact, the Legal Reality respecting the People’s Authority to Officially recognize the existence of their Creator, in all manners of expression they may so choose to make manifest in the current Affairs and Institutions of their Nation, can not be lawfully denied or abridged by any person or Governmental agency acting in any capacity in the name or stead of the People of these United States of America.

This Legal Reality exists in perpetuity as an Unalienable (non transferable) Right (quality of being that conforms to fact) inuring to the good People of this Nation..

The Authority of the People in the First Instance, that is in Constituting and Organizing a Government immortalized as "of the People, by the People and for the People," was based on this exact Legal Reality. This Legal Reality endures apparent to We the People through a firm reliance on the protection of devine Providence, in appeal to the Supreme Judge of the world for the rectitude of Our intentions, being one People entitled to a separate and equal station among Mankind, impelled by the Course of human events to secure the Blessings of Liberty to Ourselves and Our Posterity, in harmony with the Laws of Nature and Nature’s God, Our Creator.
